Terms of Service

These terms are an agreement between you and Ivan-Vladyslav Pitsur ("we", "us"), who makes Herma — the VR runtime for macOS, including its Windows bridge, its headset application and the membership service behind it (together, "Herma") — and offers it through the Patreon page at https://www.patreon.com/cw/Zuriel777. They are also the licence under which you use Herma's software. By installing or using Herma you agree to them. If you do not agree, do not use Herma.

1. What you may do
We grant you a personal, non-exclusive, non-transferable licence to install and use Herma on Macs you own or control.
- Without a membership, Herma is a free pre-alpha: you may use all of it — the room, your Mac's windows in the headset, the diagnostics — for as long as you like, and run games through it for up to 25 minutes a day in total (days run midnight to midnight UTC). The free pre-alpha checks the date with our server when a game starts, so it needs the internet then. You may not get round the daily limit, for instance by changing or removing what Herma records of it.
- With an active Patreon membership that includes Herma, connected to Herma, you may run games through Herma without that limit, on Macs you own or control.
2. Your membership
Herma is a benefit of a Patreon membership. Patreon takes the payments, sends the receipts, and handles billing, cancellations and refunds under Patreon's Terms of Use — we never see your payment details.
You connect your Patreon account in Herma once, and Herma asks Patreon about once a day whether the membership is still active. While it is, games work without a limit; when it is not — usually at the end of what you have paid for — Herma is the free pre-alpha again until you renew, and games are unlimited again by themselves when you do.
Access is for you. You may not let other people use Herma through your Patreon account, or share, sell or publish any key we give you. We may stop answering for an account that is used against this agreement.
What each Patreon tier includes, and what it costs, is shown on the Patreon page and may change; a change applies from your next billing period.
3. No refunds
We do not refund payments. Herma is digital content that you can use as soon as you subscribe, and by subscribing you ask for it to be supplied straight away and accept that, once it has been, you lose any right to withdraw from the purchase within 14 days. You can cancel on Patreon at any time, and you will not be charged again.
Patreon may still issue a refund under its own policy; that is Patreon's decision, not ours. Nothing in this section takes away rights you have by law where you live — for example if Herma is not as described.
If Herma does not work for you, message us on Patreon and we will try to help.
4. What you may not do
You may not copy Herma except as needed to use it; sell, rent or sublicense it; remove or get round its membership check; or reverse engineer it, except where the law allows you to regardless of this agreement.
5. Games and other software
Herma lets VR software run on your Mac. It does not include any games and gives you no rights to them. Games, Steam, CrossOver and other software you use with Herma are licensed to you by their own makers under their own terms. Herma is not affiliated with Patreon, Meta, Valve, CodeWeavers, Microsoft, Google or Apple, and none of them is responsible for it.
Software Herma fetches for you. Some games need parts that Herma may not ship, so Herma downloads them from their makers when they are needed: Android's platform tools from Google (to reach your headset over its cable), and Microsoft's Visual C++ 6 and DirectX redistributable packages from Microsoft (for game installers and for game sound). They are downloaded to your Mac from the makers' own servers, checked against a known fingerprint, and used only on your Mac, under the makers' own licence terms — which you accept by letting Herma fetch them. "Fix it all" and a game's first start are what fetch them.
6. What Herma changes on your Mac and your headset
To make games work, Herma changes files that belong to them and to CrossOver: it puts its own runtime into CrossOver bottles and registers it there, puts its OpenVR library into a game's folder (keeping the game's own copy beside it), sets libraries a game needs to Microsoft's own versions in that bottle, and corrects game settings that would stop a game starting or running well (for example the render size, or the controls). It says what it changed each time it does so. It does not touch your saved games. Keep your own backups of anything you would not want changed.
On the headset, Herma installs and updates its own app, and writes the word it uses to recognise your Mac, over the USB cable. This needs developer mode and USB debugging on the headset, which you switch on yourself under Meta's terms.
7. Health and safety
Virtual reality can cause motion sickness, eye strain, disorientation and, rarely, seizures. Follow your headset maker's safety guidance, keep your play area clear, take breaks, and stop if you feel unwell. Herma streams over your network or a cable, so the picture can lag or freeze on a poor link; do not rely on it where a frozen picture could cause harm.
8. No warranty
Herma is provided "as is". To the fullest extent the law allows, we make no warranties, express or implied, including that Herma will work with every headset, game or Mac, or without interruption.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss, and our total liability to you is limited to what you paid for your membership in the 12 months before the claim. Nothing in this agreement limits liability that cannot be limited by law, or takes away your rights as a consumer where you live.
10. Ending this agreement
You may stop using Herma at any time. This agreement ends automatically if you break it, and you must then stop using Herma.
11. Updates and the membership service
We may release updates. Some may be needed for Herma to keep working, including changes to how the membership is checked.
The membership check runs on our server. We aim to keep it running but do not promise that it always will be. Herma holds a pass that lasts seven days and is renewed about once a day, so games keep working through a short outage or while your Mac is offline.
12. Changes to these terms
If we change these terms, we will say so on the Patreon page before the change takes effect, and the new version will be at the same address with a new date. A change never takes away what you have already paid for; if you do not accept it, you may cancel your membership.
13. Disputes and the law
This agreement is governed by the law of the Czech Republic. If you are a consumer living elsewhere in the European Union, you keep the protection of the mandatory consumer law of the country where you live, and you may bring a claim there.
If we cannot settle a complaint between us, you may turn to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz), which resolves consumer disputes out of court, or to the equivalent body where you live.
